The question

To ask the Secretary of State for Housing, Communities and Local Government, with reference to the answer of 29 September 2025, to Question HL10508, on Rents: Appeals, what metrics will be used, and at what levels, to determine whether the Tribunal system is on course to be overwhelmed or if there are lengthy delays.

The Renters’ Rights Act contains a proportionate safeguard for use in circumstances where it has become clear that the Tribunal appears at risk of being overwhelmed by a sharp increase in challenges.

The power in question is discretionary and any decision on the part of ministers to use it would be based on the Tribunal’s capacity to manage caseloads at a given point in time. Any use of the power would be subject to the affirmative procedure, to allow appropriate parliamentary scrutiny.

My Department continues to work closely with His Majesty’s Courts and Tribunal Service to monitor the Tribunal’s capacity and caseload.
