To ask the Secretary of State for Health and Social Care, if he will make a statement on the enforcement capacity of Trading Standards in respect of the proposed high-caffeine energy drinks ban.

The Government has a commitment to ban the sale of high-caffeine energy drinks to children aged under 16 years old. This has been subject to consultation.
In the consultation, we proposed that local authorities would be responsible for enforcing any ban. Local Trading Standards officers are typically responsible for enforcing such regulations, but enforcement policy will depend on local arrangements.
The Department engaged with relevant stakeholders, including representatives for Trading Standards, to develop our proposals and estimate their impacts through the consultation stage impact assessment. A full new burdens assessment for this proposal will be developed and agreed with the Ministry of Housing, Communities and Local Government.
