The question

To ask the Secretary of State for Housing, Communities and Local Government, pursuant to the answer of 19 May 2026, to Question 448, on Mayors: Public Appointments, whether there will be a public consultation on the detailed arrangements for the new misleading offence.

A person is deemed to mislead a Local Scrutiny Committee if the committee has required the person to provide information or a document, and the person intentionally alters, suppresses, conceals or destroys the information or document.

Regulations made under the English Devolution and Community Empowerment Act will set out the detailed arrangements governing civil penalties, including when the misleading offence will apply, the circumstances in which a penalty may be imposed, and its level. This will also include the appropriate appeals route. We are consulting with the sector on the detail of these arrangements.
