The question

To ask the Secretary of State for the Home Department, whether she has made an assessment of the potential merits of allowing fiancé visa holders to work where they have a pending application to switch to a spouse and partner visa.

The intention of a fiancé(e) or proposed civil partner visa is to allow a marriage or civil partnership to take place in the UK. It is not a route to settlement.

Where the requirements of the Immigration Rules are met, entry clearance will be granted for a period not exceeding 6 months and subject to a condition of no recourse to public funds and a prohibition on employment.

Once married or having formed a civil partnership in the UK, the migrant is eligible to apply for permission to stay as a partner for 30 months. If this is granted, they will then be permitted to access employment and education in the UK.

The Government keeps all immigration policies under regular review to ensure they remain fair, proportionate and effective.
