The question

To ask the Secretary of State for the Home Department, what measures are in place to prevent a person detained in police custody who has been identified as requiring an assessment by Liaison and Diversion services from being given an out of court disposal, including a conditional caution, before that assessment has been completed; and what guidance governs decision-making in such cases.

The Home Office is unable to comment on operational police matters and decisions as policing is independent of the government. Guidance is provided to forces through the College of Policings Approved Professional Practice (APP) which includes information relating to custody and mental ill health.
