Prisoners: Equality

Asked by Nick TimothyConservativeMinistry of JusticeTabled Answered 29 June 2026UIN 12837

The question

To ask the Secretary of State for Justice, how many prisoners have successfully sued the Ministry of Justice and HMPPS over breaches of the Public Sector Equality Duty in the past year.

Answered by Jake Richards

It is rare for Public Sector Equality Duty claims to be litigated in isolation: they tend to be submitted as part of a wider claim. Litigation databases record whether a claim has an equality dimension, rather than specific information relating to the Public Sector Equality Duty.

In order to obtain the information requested, it would be necessary to conduct a comprehensive review of all Public Law cases that concluded in the past year which could not be done without incurring disproportionate cost.
